Petitioner, already in custody, seeks bail in connection with Nauhatta PS Case No.52 of 2017, registered under Sections 302, 201 and 120(B) of the Indian Penal Code. Allegation in brief is that the husband of the informant had left the home informing that he was going along with the petitioner and he did not return back and two days after his dead body was recovered.
Learned counsel for the petitioner submits that both were doing business together, merely on suspicion, the petitioner has been made accused and recovery of the so called mobile is the mobile used by both persons, even after the death of the deceased and at the time of preparation of the inquest
Patna High Court Cr.Misc. No.10329 of 2018(6) dt.07-05-2018 2/2 report, the call was received on the same mobile by the petitioner, had it been so, the petitioner would not have kept the mobile with himself and this petitioner has no criminal antecedent.
Having considered the aforesaid facts and circumstances, petitioner Mukhlal Yadav is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Rohtas in connection with Nauhatta PS Case No.52 of 2017.
