Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Basantpur P.S. Case no. 220 of 2019, registered under Sections 379, 411 and 414 of the Indian Penal Code. The accusation is that informant Rajdeo Kumar Rai went in the evening of 25.06.2019 boarding on his motorcycle in village-Baiju Barhoga to attend the marriage ceremony and parked his motorcycle there. When informant came then saw his motorcycle was not parked there and saw one person moving on his motorcycle then he asked to Manish

No.67541 of 2019(2) dt.15-11-2019 2/3 Kumar Ojha, another motorcycle borne person, to chase but intentionally he did not accelerate speed of the motorcycle then he came in suspicion about having hand in lifting motorcycle and caught hold Manish Kumar Ojha, who disclosed that Golu Kumar (Petitioner) has lifted the motorcycle and he would arrange about recovery of motorcycle and later on informed about parking his motorcycle at Khori Bazar in road side. Learned counsel for the petitioner submits that, in fact, it would appear from the F.I.R. that while allegation has been made against the petitioner to lift the motorcycle of informant, but said motorcycle was found parked inside the road. Further submission is that co-accused Manish Kumar has disclosed the name of petitioner due to enmity and petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan in connection with Basantpur P.S. Case No. 220 of 2019, subject to the condition as laid down under Section 438 (2) of
