JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-01-2020 Earlier prayer for bail of the petitioner was rejected by the then co-ordinate Bench of this Court by order dated 5.12.2018 passed in Cr.Misc.No. 59364 of 2018 and petitioner happens to be the main assailant.

Submission of learned counsel for the petitioner is that he is in custody for one and a half years and there is no substantial progress in the trial.

Heard learned APP, learned counsel for the informant and perused the report, from which it appears that now charge has been framed in this case on 16.8.2019 and processes were issued against the witnesses.

In view of above facts and circumstances, I am not inclined to grant bail to the petitioner.

However, learned trial court is directed to expedite the

Patna High Court CR. MISC. No.72937 of 2019(3) dt.10-01-2020 2/2 trial. At the same time, the Superintendent of Police, Bhojpur at Ara is also directed to ensure the presence of the witnesses in court on the date fixed, so that trial may be concluded at the earliest.

With the above observation, this application is dismissed.
