JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 27-06-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 341, 354(A), 354(C ), 354(D), 504, 506, 509 of the Indian Penal Code and Sections 8 and 12 of the POCSO Act.

It is alleged against the petitioner that he used to chase and give lewd and vulgar comments on the minor daughter of the informant.

Patna High Court CR. MISC. No.72436 of 2022(3) dt.27-06-2023 2/3 It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. Though the informant alleged that this petitioner sent vulgar pictures to the daughter of the informant but she had not produced any documents regarding the same which suggests that due to village politics, the petitioner has been roped in the present case. The petitioner is languishing in custody since 30.07.2022. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-VI-cum-Special Judge, POCSO, Banka in
