The petitioner seeks bail in connection with Sakra P.S. Case No. 56 of 2017 for offences punishable under Sections 147, 148, 149, 323, 341, 384, 427, 387, 307 and 354 of the Indian Penal Code and Section 27 of the Arms Act.
The allegation is regarding the accused persons having arrived at the Panchayat Bhawan and having engaged in assault as well as firing and breaking the articles like furniture etc. The learned counsel for the petitioner submits that the petitioner is non-FIR named accused person and he has been subsequently falsely implicated in the present case on mere suspicion. It is submitted that the petitioner is languishing in
Patna High Court Cr.Misc. No.20978 of 2018 (4) dt.17-05-2018 2/2 custody since 23.09.2017 and as far as the two cases pending against him are concerned, he is on bail.
Having regard to the facts and circumstances of the case, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SubJudge, 13th-cum-Additional Chief Judicial Magistrate, Muzaffarpur in connection with Sakra P.S.
