2. The petitioner seeks bail in a case registered for the offences punishable under Sections 304(B)/34 of the Indian Penal Code.
3. The case of the prosecution, in short, is that the daughter of the informant, namely, Banti Devi (deceased) was married to Gautam Paswan. Further allegation is that the deceased was subjected to cruelty on account of non-fulfillment of dowry demand. It has further been alleged that on 02.02.2015 at about 08:00 p.m., the informant got information that deceased is ill. When he came to the matrimonial house, the villagers told him that deceased has died due to consumption of poisonous thing and from pain in stomach.
4. Learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.71906 of 2025(2) dt.14-10-2025 2/2 that the petitioner is father-in-law and the main thrust of allegation is against the husband of the deceased. It has also been submitted that the petitioner is separate from the deceased. It is further submitted that the informant has filed an application before the Trial Court that he has come to know that the deceased has died due to Appendix and she was being treated by her in-laws.
5. Learned APP for the State vehemently opposed the bail application.
6. Considering the above facts and circumstances of the case, let petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Biharsharif/concerned court in connection with Noorsarai P.S. Case No.27 of 2015.
