Petitioner seeks bail in a case registered under Sections 395 of Indian Penal Code.

It is submitted that the first information report is against unknown persons even though the petitioner is co-villager of the informant. It is also submitted that only on the basis of suspicion, he has been implicated by the police although nothing has been recovered from his possession to suggest his involvement in the occurrence. He has also not been put on test identification parade and is in custody since 11.11.2017. Petitioner seems to be accused in other two cases but learned counsel is not in a position

Patna High Court Cr.Misc. No.16271 of 2018 (3) dt.26-04-2018 2/2 to inform this Court regarding the status of Rajgir Police Station Case No 137 of 2016 and Rajgir Police Station Case No 195 of 2013 as to whether the petitioner is on bail or not in those cases registered against him?

Considering the aforesaid submissions, the petitioner's prayer for bail is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nalanda at Biharsharif in Rajgir Police Station Case No 250 of 2017 subject to the following conditions:

(1) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(2) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
