1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Bachhwara Police Station Case No. 269 of 2024, dated 16.07.2024, disclosing offences punishable under Sections 409/420/120-B/34 of the Indian Penal Code.
3. The prosecution case, as per the First Information Report, is that the petitioner, along with other co-accused persons, misappropriated a sum of Rs. 37,56,300/-.
4. Learned Counsel for the petitioner submits that the petitioner is innocent and falsely been implicated in this case. He further submits that no amount has been defalcated by the petitioner inasmuch as the accused
Patna High Court CR. MISC. No.77655 of 2024(2) dt.21-11-2024 2/3 persons had deposited the alleged defalcated amount in unclassified accounts. He further submits that the petitioner has been suspended from his job. He next submits that similarly situated co-accused Gorakh Choudhary has been granted anticipatory bail by a coordinate Bench of this Court, vide order, dated 23.10.2024, passed in Criminal Misc. No. 73117 of 2024.

Regards being had to the submissions advanced on behalf of the parties and taking into consideration the fact that the allegation against the petitioner is based upon documents and custodial interrogation of the petitioner may not be required and similarly situated co-accused has been granted anticipatory bail by this Court, I am inclined to grant the petitioner privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Bachhwara Police Station Case No. 269 of 2024, subject
