JUSTICE RAJIV ROY ORAL ORDER 20-01-2023 Heard learned counsel for the petitioner and the State through video conferencing in view of the Covid-19.. The petitioner apprehends his arrest in connection with Suppi P.S. Case No. 314 of 2022 instituted under Sections 30(a) of Bihar Prohibition and Excise Amendment Act, 2018. As per the prosecution story, the police upon secret informant started checking the vehicle and intercepted a tempo. While other accused escaped, one Rahul Kumar was apprehended and 555 bottles of Nepali Saufi wine totalling 166.5 litres was/were recovered/seized. Accordingly, the FIR was lodged.
The name of the petitioner came in the confessional statement of Rahul Kumar.
In view of the fact that the petitioner has criminal
Patna High Court CR. MISC. No.72522 of 2022(2) dt.20-01-2023 2/2 antecedent of the same nature, certainly it is not a fit case for extending benefit of anticipatory bail which is accordingly rejected.
If however, the petitioner(s) surrenders within four weeks from today before the concerned court and file bail petition along with relevant documents, the court shall take into account the facts available on record and dispose of the same expeditiously without doing prejudice by observation of this Court.
