ANJANA MISHRA ORAL ORDER 09-05-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 12.02.2018 in connection with Atri P.S. Case No.31 of 2018 registered for the offences under Section 418, 419 and 420 of the Indian Penal Code.

Learned counsel for the petitioner submits that altogether misconceived allegation has been made against the petitioner, stating that he was running a clinic without any licence. It is further submitted that Annexure 2 clearly shows that the petitioner was only assisting Dr. Dhananjay Kumar, who has a valid licence for running the said Clinic. It is thus submitted that the prosecution against the petitioner is wholly

Patna High Court Cr.Misc. No.21251 of 2018 (3) dt.09-05-2018 2/2 malicious and he may be released on bail.

Diary in the present case was called for, which has since been received.

After perusal of the diary it seems that the case is not maintainable in the manner as has been alleged. It is apparent from perusal of the F.I.R. that one person was helping the said Dr. Dhananjay Kumar in smooth running of the said clinic and thus the allegation that the petitioner has the role in running of the said clinic illegally, is not in accordance with the facts and circumstances of the case.

In view of the aforementioned facts and circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya, in connection with Atri P.S Case No.31 of 2018.
