The petitioner seeks bail in connection with Paliganj P.S. Case No. 227 of 2019 registered for the offences punishable under Sections 25(1-b) a, and 26 of the Arms Act. The prosecution, in brief, is that one S.I. Vikash Kuamr, who happened to be informant of this case, rcorded his self written report, on the basis of which aforesaid F.I.R. was lodged, alleging therein that on 30.06.2019 at about 18.30 Hours, on the basis of secret information, he along with other police personnel in the leadership of S.D.P.O., Paliganj, conducted raid in the village Kalyanpur to arrest the accused of Paliganj P.S. Case No.176 of 2019 registered under Sections 385 and 387 of the I.P.C. namely Vikash Kuamr (petitioner). During course of raid, one person wanted to flee away from the Bullet Motorcycle, but on chase that person was apprehended along

Patna High Court CR. MISC. No.65084 of 2019(2) dt.05-11-2019 2/2 with Bullet Motorcycle. On interrogation, arrested person disclosed his name as Vikash Kumar (petitioner). In presence of witnesses arrested petitioner was searched and from the possession of the petitioner, one loaded country made Katta and a live cartridge were recovered. Accordingly, in presence of the witnesses seizure list of recovered arms and ammunitions along with Bullet Motorcycle were prepared, over which accusedpetitioner also put his signature. Petitioner neither produce any valid documents nor gave satisfactory answer regarding possession of illegal arms and ammunitions. Accordingly, the petitioner was remanded in this case.

The petitioner is in jail custody since 01.07.2019. The petitioner has got no criminal antecedent which is mentioned in paragraph-3 of the bail petition. I am not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner is hereby rejected.

However, the petitioner may renew his prayer for bail after completion of six months in jail custody. (Anjani Kumar Sharan, J) Nasimul/- U T
