Petitioner is an accused in a case registered for offence under Sections 379, 401, 411, 414, 120(B), 34 of the Indian penal Code and Sections 25(1-b)a/26/35 of the Arms Act. Learned counsel for the petitioner submits that at best the allegations constitute a failed attempt of looting the A.T.M. Petitioner has not been arrested from the A.T.M. itself but at a distance and he has denied the allegation for recovery of the looted country made pistol from his possession. He is having no criminal antecedent and is in custody since 23.12.2017. Charge sheet has already been submitted.

Considering the aforesaid submissions, prayer for

Patna High Court Cr.Misc. No.21803 of 2018 (3) dt.22-05-2018 2/2 bail of the petitioner is allowed. Let the petitioner, mentioned above, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Sub-Judge 1st -cum- A.C.J.M., West Muzaffarpur in Saraiya P.S. Case No.476 of 2017 on the following conditions : - One of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner and The petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
