2. The petitioner seeks pre-arrest bail in connection with Benipatti P.S.Case No.119/2024 registered for the offence punishable under Sections 302/34 of the Indian Penal Code.

3. As per the allegation made in the FIR, all the accused persons named in the FIR along with other accused persons killed the son of the informant.

4. Having considered the rival submissions made on behalf of the parties, as well as, considering the nature of allegation made in the FIR, I am not inclined to enlarge the

Patna High Court CR. MISC. No.78296 of 2024(2) dt.04-12-2024 2/2 petitioner on pre-arrest bail.

5. However, the petitioner, if so advised, may surrender before the learned District Court and seek regular bail and the learned District Court is directed to consider the regular bail application of the petitioner on the same day and pass a reasoned order as per the provision of law and the evidence.

6. Accordingly, the present bail application is disposed of.
