The petitioner seeks regular bail in connection with Kotwali P.S. Case No. 476 of 2017 for the offences punishable under Sections 304(b)/34 of the Indian Penal Code. The allegation is regarding the victim lady having been done to death on account of non-fulfillment of demand of dowry.
The learned senior counsel for the petitioner, pointing out from various paragraphs of the case diary, has submitted that admittedly the victim lady has committed suicide by hanging herself and the door of the room where the victim lady has committed suicide was closed from inside, which was opened in presence of the police and then it was found that the victim lady
Patna High Court Cr.Misc. No.23246 of 2018 (5) dt.02-07-2018 2/2 had hanged herself leading to her death. It is further submitted that during the course of investigation, no allegation of abetment of suicide has been levelled inasmuch as the charge sheet has also been filed under section 304B of I.P.C., hence the complicity of the petitioner is not proved by any stretch of imagination. It is further submitted that the petitioner is having a clean antecedent and is languishing in custody since 19.09.2017. Per contra, the learned counsel for the informant has vehemently opposed the prayer for bail.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to each the satisfaction of learned Chief Judicial Magistrate, Patna in connection with Kotwali P.S. Case No. 476 of 2017.
