1. Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner apprehends his arrest in connection with Barauni P.S. Case no.243 of 2022 registered under Sections 308, 147, 341, 323, 504 and 506 of the Indian Penal Code.
3. As per the prosecution case, on 30.05.2022 at about 10:00 p.m. all five named accused persons including the petitioner herein came to the house of the informant variously armed and started abusing the informant. On protest, accused Kiran Devi assaulted the informant with lathi and danda.
Patna High Court CR. MISC. No.77418 of 2024(3) dt.19-04-2025 2/3 Accused Mithun Kumar assaulted the son of the informant with an iron rod on his head due to which he sustained grievous injuries and the petitioner along with one Munna Singh also assaulted her son Sharwan Kumar with lathi and danda.
4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. There is general and omnibus allegation levelled against the petitioner of assault upon Sharwan Kumar. It is the accused Mithun Kumar who assaulted the son of the informant with an iron rod causing grievous injuries on his head, a copy of the injury report has been annexed as Annexure-3 to the application. The petitioner has no criminal antecedent and undertakes to cooperate in the case/trial.
5. The application for anticipatory bail is opposed by learned A.P.P. for the State.
6. In view of the entire facts and circumstances of the case, it is directed that the petitioner above named, having no criminal antecedent in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Barauni P.S. Case no.243 of 2022 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount
Patna High Court CR. MISC. No.77418 of 2024(3) dt.19-04-2025 3/3 each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure/Section 482(2) of the B.N.S.S, 2023.
