The petitioner seeks regular bail in connection with K. Hat P.S. Case No. 765 of 2017 for the offences punishable under Sections 456 and 380 of the Indian Penal Code. The allegation is regarding commission of theft by the accused persons in the house of the informant. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case on the confessional statement of the co-accused person namely Mohd. Kaif Ashif. It is submitted that not only in the present case but inasmuch as in four cases the petitioner has been falsely implicated on account of sole confessional statement of the coaccused Mohd. Kaif Ashif. It is further submitted by the learned

Patna High Court Cr.Misc. No.23934 of 2018 (4) dt.02-07-2018 2/2 counsel for the petitioner that neither T.I. Parade has taken place, nor any recovery of the looted article has been made from possession of the petitioner herein. The petitioner is stated to be languishing in custody on 01.12.2017.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in connection with K.Hat P.S. Case No. 765 of 2017.
