The petitioner filed this writ petition for direction to the respondents to pay subsistence allowance of the petitioner during his period of suspension. The petitioner was put under suspension vide letter as contained in Memo No.1599, dated 18.12.2018 issued under the signature of the District Magistrate, East Champaran, Motihari but till date the petitioner has not been paid his subsistence allowance.

Learned counsel for the petitioner submits that the

Patna High Court CWJC No.20569 of 2019(2) dt.25-11-2019 2/2 petitioner may be permitted to file petition before the District Magistrate and the Land Acquisition Authority-cum-Enquiry Officer, East Champaran, Motihari for payment of his subsistence allowance.

Prayer is allowed. The writ petition is disposed of with a direction to the petitioner to file petition before the District Magistrate and the Land Acquisition Authority-cumEnquiry Officer, East Champaran, Motihari for payment of his subsistence allowance during the period of his suspension. If such petition is filed, The District Magistrate, East Champaran, Motihari shall pass order in accordance with law within two months from the date of filing of such petition along with this order.

With the aforesaid observation/direction, the writ petition is disposed of.
