This is the second attempt of the petitioner to seek bail as earlier vide order dated 21.04.2022 in Cr. Misc. No. 68522 of 2021, his prayer for bail was permitted to be withdrawn.
Learned senior counsel for the petitioner submits that petitioner has remained in custody since 18.09.2021 and is the father-in-law of the informant (victim), it is next submitted that though it is alleged that petitioner assaulted the victim causing injury in her eye but then the same is in realm of allegation, it is also submitted that whenever any dispute arises between husband and wife, the entire family members are implicated.

No.72812 of 2022(2) dt.21-12-2022 2/2 Learned senior counsel further submits that until now Doctor and Investigating Officer have not been examined and P.W.5 was declared hostile and there is no likelihood of early conclusion of the trial Learned A.P.P. for the State opposes the prayer for bail of the petitioner.
Considering the submissions made by the learned senior counsel for the petitioner and also taking into account the period of custody of the petitioner, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Mehandia P.S. Case No. 16 of 2021.
