JUSTICE BIRENDRA KUMAR ORAL ORDER 18-06-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is languishing in custody for the offences punishable under Sections 147/ 148/ 149/ 120(B) /121(a)/ 122/ 124(a) of the Indian Penal Code, Sections 25(1-b) a/26 of the Arms Act and Section 3/ 4 of the Explosive Substances Act and Sections 16/ 17/ 18/ 19/ 20/ 21/ 22 of the U.A.P. Act. The FIR would reveal that the firearm etc, were recovered from the physical possession of the petitioner, however, the seizure list does not reveal that the recovery was made from the physical possession of the petitioner rather; recovery was from the Jungle.
Considering the aforesaid infirmity and custody of
Patna High Court Cr.Misc. No.13088 of 2018 (6) dt.18-06-2018 P2/ the petitioner since 06.01.2017, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.50,000/- (Fifty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Simultalla P.S. Case No.01 of 2017, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. Both the bailors shall be resident of the territorial jurisdiction of the Court below having immovable property in their names. (Birendra Kumar, J) Mkr./- U T
