1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Gaya Rail G.R.P. P.S. Case no. 172 of 2023 registered under section 414 of the Indian Penal Code.

3. As per the prosecution case, the petitioner was arrested on the Gaya Railway Station along with a bag containing stolen articles including mobile phones, cash, gold jewelry besides other articles for which the petitioner had no explanation.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. No incriminating article has been recovered from the petitioner's possession. He is in custody since 13.6.2023 and has no

5. The application for bail is opposed by learned A.P.P. for the State.

6. Having heard the learned counsel for the parties and taking into consideration the allegations against the petitioner, him having remained in custody for about 8 months since 13.6.2023, not having any criminal antecedent and charge sheet having been submitted in the case, this Court directs the petitioner to be released on bail in connection with G.R.P. (Gaya) Rail P.S. Case no. 172 of 2023 on his furnishing bail bond of Rs 10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Railway Judicial Magistrate, Gaya.
