Petitioner, already in custody, seeks bail in connection with Chandi PS Case No.3 of 2017, registered under Section 392 of the Indian Penal Code.

Allegation in brief is that some miscreants robbed Rs.5500/- from the truck driver and petitioner's name was disclosed by villagers raising suspicion against him. It is contended that except the confessional statement, there is no other material against the petitioner, neither any money was recovered from possession of the petitioner nor he was put on TIP and he has clean antecedent, moreover similarly situated another co-accused Ramdhari Kumar has been admitted to bail by a co-ordinate Bench of this Court vide Cr. Misc.

Patna High Court Cr.Misc. No.13815 of 2018(3) dt.02-05-2018 2/2 No.16863 of 2017 on 27.04.2017.

Having considered the aforesaid facts and circumstances, petitioner Deepak Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Ara in connection with Chandi PS Case No.3 of 2017, giving rise to Sessions Trial No.268 of 2017.
