In this case, the petitioner is seeking regular bail in connection with Sarairanjan P.S. Case No. 188 of 2019, registered for the offences punishable under Sections 307, 323, 420, 498A, 494 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.

There is allegation against the petitioner that he committed atrocities upon his wife, the complainant. The learned counsel for the petitioner has submitted that the petitioner was granted bail by the learned trial court. Allegedly, he did not adhere to his words of keeping his wife with full dignity and honour and it was the reason that his bail bond was cancelled. He has submitted further that the entire allegation is false. The petitioner is still ready to keep his wife

Patna High Court CR. MISC. No.72429 of 2022(3) dt.28-03-2023 2/2 with full dignity and hounour, but she herself is not willing to reside with him. He is a person of clean antecedent. He is under custody since 01.09.2022.

Considering the clean antecedents as well as the period of detention, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned court below in connection with Sarairanjan P.S. Case No. 188 of 2019, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.
