JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-01-2020 Petitioner seeks bail in connection with Special Case No. 706 of 2018, arising out of Fulkaha P.S. Case No. 105 of 2018 registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act.

There is recovery of more than 500 litres of liquor from the bamboo clamp in front of house of the petitioner and he is accused in three other cases of similar nature. Submission of learned counsel for the petitioner is that nothing has been recovered from his possession and three persons are named in the FIR and he is in custody for more than four months.

Heard learned APP, who has opposed the prayer for bail stating that petitioner is named in the FIR and there is recovery of liquor from in front of his house and he has criminal

In view of above facts and circumstances, I am not inclined to grant bail to the petitioner at this stage. Accordingly, this application is dismissed.
