2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Section 309(4) of the Bharatiya Nyaya Sanhita.

3. The case of the prosecution is that four boys entered in the house of the informant when he was not at his house and looted jewellery and cash of Rs. 20,000/- and also a mobile was carried away by the miscreants.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. He has got no criminal antecedent. During course of investigation, one Pukar Sahani has given his confessional statement in which, he has named

It is next submitted that similarly situated petitioner has been granted bail by this Court vide Cr. Misc. No. 79197 of 2024. It is further submitted that the petitioner is languishing in judicial custody since 28.07.2024.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Manigachhi P.S. Case No. 136 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VI, Darbhanga.
