JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-05-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under sections 147, 148, 341, 323, 384 and 506 of the Indian Penal Code.

As per the prosecution case, all the accused persons came at the place where informant was irrigating the field, and demanded ransom of Rs. 5 lakhs. They threatened the informant stating that he will only be allowed to irrigate the field only after giving the said amount. On objection, the accused Munna Chaudhary gave iron rod blow upon the informant. Learned counsel for the petitioner submits that the petitioner is accused of assaulting the informant with iron rod due to which he sustained injury. Doctor has found the injury

Patna High Court CR. MISC. No.2255 of 2023(2) dt.08-05-2023 2/2 simple in nature. There was delay of 3 days in lodging the FIR and there is no explanation of delay. The petitioner has got no criminal antecedent.

Learned counsel for the State opposes the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., West Champaran, Bettiah in connection with Sathi P.S. case no. 34 of 2018 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
