The petitioner seeks regular bail in connection with Udwantnagar P.S. Case No. 395 of 2017 for the offences punishable under Sections 341, 323, 307, 504/34 and 386 of the Indian Penal Code.
The allegation in the present case is that the accused persons had tried to kill the informant. It is alleged that the petitioner alongwith co-accused Manish Singh had fired on the knee of the informant resulting in injury to the informant. The learned counsel for the petitioner submits that if the petitioner would have any intention to kill the informant then the firing would not have been made on the knee of the informant but on the vital part of the informant. It is further submitted that
Patna High Court Cr.Misc. No.20259 of 2018 (3) dt.28-06-2018 2/2 the allegation of firing is on two persons, however, there is only one fire arm injury on the informant. The petitioner is stated to be in custody since 12.12.2017.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Udwantnagar P.S. Case No. 395 of 2017.
It is further directed that the petitioner shall mark his attendance before the concerned Police station on every Monday of the week at 10 A.M. and co-operate in the investigation.
