The petitioner seeks regular bail in connection with Barsoi P.S. Case No. 214 of 2017, registered for the offence punishable under Sections 302, 307, 326, 436, 120-B/34 of the Indian Penal Code.

The allegation is regarding the petitioner having poured kerosene oil on his mother, father, brother, sister-in-law and niece and thereafter, had set them on fire resulting in death. The learned counsel for the petitioner referring to the case diary has submitted that the fact is that some explosive substance was kept in the house and the same caught fire resulting in explosion which has caused the death of the deceased persons. No.20410 of 2018(4) dt.02-07-2018 2/2 have also stated in their statement made before the police that they had heard the sound of firecracker and then, gone to the house and found that the deceased persons had got burnt. Lastly, it is submitted that the petitioner is having a clean antecedent and he is languishing in custody since 29.07.2017. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail. Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M, Katihar in connection with Barsoi P.S. Case No. 214 of 2017.

It is further directed that the petitioner would mark his attendance before the Officer-in-Charge of the concerned police station at 10:00 am. on each Monday of the week and in the event of two consecutive defaults, the present privilege of the regular bail shall stand cancelled automatically.
