2. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 30 (a) of the Bihar Prohibition and Excise Act, 2018.

3. The case of the prosecution is that from one Roshan Kumar, altogether 21.6 liters of country made liquor was recovered. It is further alleged that the petitioner fled away after seeing the police. The name of the petitioner has been disclosed by the said Roshan Kumar.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that nothing has been recovered from the conscious possession of

Patna High Court CR. MISC. No.72052 of 2025(2) dt.09-10-2025 2/2 this petitioner rather his name has been transpired on the basis of the confessional statement of co-accused, namely, Roshan Kumar. It is further submitted that petitioner has six criminal antecedent due to which he has been framed in this case. Moreover, the petitioner is languishing in judicial custody since 17.07.2025.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Kushrupur P.S. Case No. 115 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge Excise Court, Patna City, subject to the condition that the petitioner shall not indulge himself in similar nature of case in future.
