1. Heard learned counsel for the petitioners and learned APP for the State.

2. The petitioners seek bail in anticipation of their arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 109, 333, 74, 352, 351(2), 3(5) of the B.N.S.

3. The learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and the informant alleges that she stays alone in the house with her children. Further, on 25.07.2025 at 8.00 P.M. her brother in-law (Dewar, Bablu) assaulted her but the dispute was settled. It is next alleged that on 26.07.2025 at 6.00 AM Pravesh, Bablu,

Patna High Court CR. MISC. No.71069 of 2025(2) dt.10-11-2025 2/3 Anita, Putul and Nitish came armed with lathi and assaulted her causing injury on head and Pravesh tried to strangulate her. On alarm, villagers came and she was saved and was taken to the doctor for treatment.

4. The learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is next submitted that from perusal of the allegation as alleged in the FIR, it would manifest that allegation of assault is general and omnibus in nature. It is next submitted that allegation of strangulation has been made only to give seriousness to the case. It is also submitted that on account of dispute relating to property, petitioners came to be implicated. It is next submitted that the date of occurrence is 26.07.2025 and the FIR came to be instituted on 01.08.2025 and the same reached the learned trial Court on 07.08.2025, which casts an aspersion on the case of the prosecution.

5. Learned A.P.P. opposes the anticipatory bail application.

6. Considering the submissions made by the learned counsel for the petitioners, the petitioners, above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks, are directed to be released on

No.71069 of 2025(2) dt.10-11-2025 3/3 anticipatory bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Ms. Anita Kumari, the learned J.M. 1st Class, Nawada in connection with Roh P. S. Case No.253 of 2025, subject to the conditions laid down under Section 482(2) of the BNSS.
