2. The petitioner apprehends his arrest in connection with Vishambharpur P.S. Case No. 53 of 2021 for the offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act.

3. 90 liters of country-made liquor was recovered. One Basai Yadav@ Badashah Yadav and the petitioner are accused of dealing in illicit liquor.

4. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail.

5. Considering the fact that the petitioner was not caught on the spot, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be

No.75930 of 2024(2) dt.11-12-2024 2/2 released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge IV cum Exclusive Special Judge, Excise Court No. II, Gopalganj in connection with Vishambharpur P.S. Case No. 53 of 2021 subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.

6. This is also subject to the condition that the petitioner shall deposit an amount of Rs. 25,000/- (Rupees Twenty-five Thousand Only) in Ramakrishna Mission Ashrama, opposite Circuit House, Chapra and produce the receipt of the same before the Court below. The bail bonds of the petitioner shall be accepted after verifying the genuineness of the receipt produced by the petitioner.

7. The petitioner is directed to mark his attendance in Kuchaikote police station on 1st Sunday of every month. Failure to do so, will result in cancellation of bail bond of the petitioner. (Sandeep Kumar, J) Saif/- U T
