The petitioner seeks regular bail in connection with Saharghat PS case no. 126 of 2017 instituted for the offences punishable under Sections 363, 366(a)/34 Arms Act. The allegation is regarding the accused persons having abducted the victim girl.

The learned counsel for the petitioner has produced the statement of victim girl recorded under Section 164 Cr.P.C. which is taken on record, to contend that the victim girl has only named the husband of the petitioner as the person who had abducted the victim girl, hence the petitioner should not be saddled for the misdeed of her husband. Having regard to the facts and circumstances of the case, more particularly the fact that the main accused in the present case is the husband of the petitioner herein namely Md. Atabul, against whom prima facie case has been found to be true, I deem it fit and appropriate to release the petitioner on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M. Benipatti, Madhubani in connection with Saharghat PS case no. 126 of 2017.
