This is a petition for grant of regular bail in connection with S. Tr. No. 19 of 2018 arising out of Sangrampur P.S. Case No. 36 of 2013 for offences under Sections 302 and 34 of the Indian Penal Code and 27 of the Arms Act.
Learned counsel for the petitioner submits that the first information report is against unknown and petitioner has been made accused in this case only because he is brother of one Bablu Dubey @ Mithilesh Dubey. It is also submitted tht other co-accused persons, Jitendra Upadhya, Amit Tiwari, Vikas Mishra have been admitted to bail by coordinate Benches of this
Patna High Court Cr.Misc. No.21870 of 2018(2) dt.06-07-2018 2/2 Court.
Having considered the aforesaid facts and circumstances, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with S. Tr. No. 19 of 2018 arising out of Sangrampur P.S. Case No. 36 of 2013 to the satisfaction of the Chief Judicial Magistrate, East Champaran at Motihari, subject to the conditions that (i) one of the bailors must be the close family member of the petitioner and (ii) the petitioner shall remain physically present on each and every date before the trial Court and if he absents himself on two consecutive dates without any reasonable cause, his bail bond shall liable to be cancelled.
