1. Heard learned counsel for the petitioner, learned GP-25 for the State, learned counsel appearing for the Bhim Rao Ambedkar Bihar University and the learned senior counsel appearing on behalf of the respondent no.7.

2. The learned counsel for the petitioner straight away draws the attention of the Court to Annexure- P/4 to the writ application at Page-24 and submits that earlier he had represented before the S.D.O. Mahua, who is one of the Member of the Managing Committee, bringing to his notice that

Patna High Court CWJC No.16642 of 2024(2) dt.21-11-2024 2/2 despite taking work from the petitioner, he is not being paid his remuneration by the college in question, on which the S.D.O. had sought a report from the Principal of the College, who issued letter dated 13.09.2024 (Annexure- P/4), wherein it has been recorded that the college in question does not get any grant from the government and is facing financial starvation, but whenever funds would come, the petitioner would also be paid his share in accordance seniority.

3. The learned counsel for the petitioner thus seeks permission to withdraw the present writ application with liberty to pursue his remedy before the concerned officials in view of Annexure- P/4 to the writ application.

4. Permission is accorded.

5. Accordingly, instant writ petition is dismissed as withdrawn with the liberty aforesaid.
