JUSTICE ARUN KUMAR ORAL ORDER 29-06-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 21.10.2017, seeks bail in Chandramandi PS Case No. 105 of 2017 registered under Sections 399, 402 of the IPC and Sections 25(1-b)a and 26 of the Arms Act. The allegation in brief is that the police apprehended the petitioner on suspicion and recovered one country made loaded pistol from his possession along with one motorcycle and four mobiles.

Learned Counsel for the petitioner submits that the recovery is fabricated, petitioner is in custody since 21.10.2017 and bears no criminal antecedent.

Having considered the said facts and circumstances, the petitioner, namely, Rinku Yadav is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM lst Jamui in connection with Chandramandi PS Case No. 105 of 2017, subject to verification of his antecedent and if criminal antecedent is found he shall not be released.
