Petitioner is an accused in a case registered for offence under Sections 302/201 of the Indian Penal Code and Section 27 of the Arms Act..

It is submitted by the learned counsel for the petitioner that co-accused Bishambhar Pandit and Sharda Pandit Upadhyey have in their confessional statement named the petitioner, since petitioner's father lodged a criminal case against Bishambhar Pandit. Other than confessional statement of coaccused, there is no cogent material against the petitioner. He is having no criminal antecedent and is in custody in connection with

Patna High Court Cr.Misc. No.23533 of 2018 (3) dt.24-05-2018 2/2 this case on 22.1.2018.

Considering the aforesaid submissions, prayer for bail of the petitioner is allowed. Let the petitioner, mentioned above, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-1V, Buxar in Buxar (M) P.S. Case No.58 of 2016 on the following conditions : - One of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner and The petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
