2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Section 309(2) of the Bharatiya Nyaya Sanhita.
3. The case of the prosecution is that the informant is a field staff in Fusion Finance Ltd., Ara and on 14.08.2024, at about 7:30 AM, he left the main branch for Narayanpur and after collection of Rs. 64,170/- was returning and as soon as he reached Maranpur at about 11:50 AM, three persons riding on Apache bike, who have covered their face, pushed him and snatched the bag containing cash.
4. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.76653 of 2024(5) dt.02-04-2025 2/3 petitioner is innocent and has committed no offence. He has falsely been implicated in this case. It is also submitted that the name of this petitioner has surfaced in the CDR where mobile location of this petitioner was found at the place of occurrence at 11:40 AM. It is also submitted that according to the FIR, the occurrence is of 11:50 AM. The location of mobile of this petitioner was found ten minutes prior to the occurrence. This petitioner has also given his statement before the police and has admitted his guilt, and on his disclosure, the black color bag was recovered besides the road. It has also been submitted that no TIP of alleged bag was conducted by the police. It is further submitted that the petitioner is languishing in judicial custody since 19.08.2024.
5. Learned APP appearing for the state has opposed the prayer of regular bail and submitted that the petitioner is having criminal antecedent of one case.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Narayanpur P.S. Case No. 66 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount
