The petitioner has been in custody since 07.06.2017 in connection with Town(Chapra) P.S. Case No. 240/2017 registered for the offences punishable under Sections 399/402/414 of the Indian Penal Code and Section 25(1-b) a/26/35 of the Arms Act.
Learned counsel for the petitioner submits that the petitioner was apprehended only on suspicion and there has been no recovery from his conscious possession. Learned counsel for the petitioner further submits that save and except the said statement made in the First Information Report, there is no further material to implicate the petitioner with the allegations as made
Patna High Court Cr.Misc. No.21759 of 2018 (4) dt.10-05-2018 2/2 out in the First Information Report. It is further submitted that the petitioner's name has been brought in, on the basis of the confessional statement made before the police by one co-accused. Considering the aforementioned facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran at Chapra, in connection with Town(Chapra) P.S. Case No. 240/2017.
