2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 126(2), 115(2), 109, 3(5) of the B.N.S. and Section 25(1-B)a, 26, 27, 35 of the Arms Act.
3 . The allegation in the FIR is that the informant was intercepted by five persons and subsequently, it has been alleged that eight persons indulged in hurling abuses and assault and
Patna High Court CR. MISC. No.71485 of 2025(2) dt.13-10-2025 2/3 thereafter, when the villagers assembled, co-accused Akhilesh Kumar and Raju Kumar opened fire upon the informant. The pistol was, however, snatched away by the villagers.
4. Learned counsel for the petitioner contended that allegation is general and omnibus against this petitioner. It is further contended that there is land dispute between the parties for which a title suit bearing Title Suit No. 76 of 2009 is also pending between them. Specific allegation of opening fire is against Akhilesh Kumar and Raju Kumar and not against this petitioner. Similarly situated co-accused person has already been granted bail by Co-ordinate Bench of this Hon'ble Court vide order dated 25.07.2025 in Cr. Misc. No. 49115 of 2025 . Petitioner claims clean antecedent.
5 . Learned counsel for the State opposed the bail petition .
6 Considering the aforesaid facts, general and omnibus allegation , clean antecedent of the petitioner and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM Rosera Samastipur
