The petitioner seeks regular bail in connection with Kotwali (Adampur) PS case no. 612 of 2016 instituted for the offences punishable under Sections 304-B, 120-B of Indian Penal Code.

As far as the petitioner no. 1 is concerned, who is the husband of the victim lady, the learned counsel for the said petitioner seeks to withdraw the present petition with a request to this Court to direct for expediting the trial. Now coming to the merits of the case, the allegation is regarding killing of the victim lady on account of want of dowry.

No.21852 of 2018 (5) dt.02-07-2018 2/2 The learned counsel for the petitioners submits that most of the private witnesses and the informant of the present case have been examined in the present case and they have not named the petitioner no. 2 as perpetrator of the crime and the petitioner no. 2 is languishing in custody since 09.11.2016. It is further submitted that the petitioner no. 2 is having a clean antecedent.

Having regard to the facts and circumstances of the case, the petitioner no. 2 is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Addl. Sessions Judge-Vth, Bhagalpur in connection with Kotwali (Adampur) PS case no. 612 of 2016.

In view of the fact that all the witnesses except the I.O. and the doctor have been examined in the present case and the petitioner no. 1 is languishing in custody since 09.11.2016, I deem it fit and appropriate to direct the trial court to expedite the trial and complete the same preferably within six months from today.
