The petitioner is in custody since 03.12.2017 in connection with Parbatta (Maraiya) P.S. Case No. 267 of 2017 for the offence registered under Sections 304B, 201/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is a 60 per cent physically disabled person and the deceased lady was not interested to live with him. She had fled away with her paramour. It is further submitted that on the basis of suspicion and presumption that the victim lady has been done to death, the present petitioner has been implicated in the present case.

Patna High Court Cr.Misc. No.19823 of 2018 (3) dt.02-05-2018 Learned counsel for the State after perusal of the case diary submits that there is no further material in the case diary to support that the deceased lady has, in fact, been killed by the present petitioner.

Considering the aforesaid facts and circumstances of the case and that since only on presumption the petitioner has been taken into custody, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., 1st, Khagaria in connection with Parbatta (Maraiya) P.S. Case No. 267 of 2017.
