The petitioner is apprehending his arrest in connection with Kotwa PS Case No.151 of 2018 registered for offences punishable under Sections 147, 148, 149, 341, 323, 324, 325, 307, 354(B), 379, 302 of the Indian Penal Code. As per FIR, petitioner and other co-accused persons have assaulted the deceased causing his death.

Submission of the learned counsel for the petitioner is that there is no repetition of blow and there was no intention to kill him.

Heard learned A.P.P. who has opposed the prayer for bail ..

Having heard both sides and in view of the facts and circumstances, as stated above, as well as the petitioner is also

Patna High Court CR. MISC. No.70995 of 2019(3) dt.18-11-2019 2/2 one of the assailant, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail.

With the aforesaid direction, this application is dismissed.
