Petitioners are accused in a case registered for offence under sections 341, 323, 324, 307,504/34 IPC. By referring to the injury report, Annexure 2 learned counsel for the petitioners submits that the alleged manner of assault is not corroborated by the injury report. He submits that the petitioners have falsely been implicated in this case owing to a dispute between children of both parties. Counter case was also lodged by the petitioners side as some persons from their side have also received injuries. Similarly situated co-accused Suresh Ram has already been granted anticipatory bail vide order dated 6.4.2018, passed in Cr Misc No. 17191 of 2018. Prior to the

Patna High Court Cr.Misc. No.17087 of 2018 (3) dt.27-04-2018 lodging of this case, petitioners are not accused in other case and they are in custody in connection with this case since 6.1.2018. Considering the aforesaid submissions, prayer for bail of the petitioners is allowed. Let the petitioners, mentioned above, be released on bail on furnishing bail bond of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate V, Bettiah, West Champaran on the following grounds:- (a) One of the bailors will be a close relative of the petitioners who will give an affidavit giving genealogy as to how they are related with the petitioners. The bailor will also undertake to inform the Court if there is any change in the address of the petitioners and (b) The Petitioners will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
