The petitioner seeks regular bail in connection with Kudhani P.S. Case No. 22 of 2017, registered for the offence punishable under Section 395 of the Indian Penal Code. It is submitted by the learned counsel for the petitioner that on the basis of allegation regarding snatching money from the informant, two cases were lodged i.e. one by the police and the other by the informant. It is further submitted that in the case lodged by the police i.e. Ramgarh (Nuaon) P.S. Case No. 313 of 2017, the petitioner has been granted bail and the present case is arising out of the case filed by the informant for the same incident. It is further

Patna High Court Cr.Misc. No.21733 of 2018(3) dt.17-05-2018 2/2 submitted that except the statement of the co-accused, there is nothing to implicate the petitioner in the present case. The petitioner is said to be accused in two other cases in which he is on bail. The petitioner is said to be languishing since 24.01.2018. It is also the submission of the learned counsel for the petitioner that co-accused person, namely, Alok Kumar has already been granted bail by this Court by an order dated 05.04.2018 passed in Criminal Miscellaneous No. 12425 of 2018.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-III, Bhabua (Kaimur) in connection with Kudhani P.S.
