Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 13.7.2017 passed in Cr. Misc. No. -31675 of 2017, as there is allegation against the petitioner of firing causing injury and he was accused in ten other cases.

Submission of the learned counsel for the petitioner is that he is in custody for about 18 months and up-till-now the charge has not been framed.

Heard learned A.P.P. also.

From perusal of the report it appears that up-till-now the case is pending for appearance. In such view of the matter and also considering the period of custody, let the petitioner above

Patna High Court Cr.Misc. No.21521 of 2018 (3) dt.02-05-2018 2/2 named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Saharsa in connection with S.T. No.164 of 2017 arising out of Saharsa Sadar P.S.Case no.856 of 2016, with condition that he will co-operate in disposal of the trial and will also appear as and when required by the learned court below; otherwise his bail bond shall be cancelled.

With the aforesaid observation, this application is allowed.
