This is a case registered under Sections 302/34, 120B of the Indian Penal Code and 27 of the Arms Act in connection with Lakhisarai (Kabaiya) P.S. Case o. 469 of 2017 Pending in the court of Chief Judicial Magistrate, Lakhisarai District Lakhisarai. It is submitted by the petitioner's counsel that the allegation of causing firearm injury is upon the co-accused Vickky Kumar. He submits that at best the allegation against the petitioner is of exhorting the co-accused to cause firearm injury upon the deceased son of the informant.
This Court finds from the FIR as well as the statement of the witnesses during course of investigation, there is
Patna High Court Cr.Misc. No.17568 of 2018 (3) dt.03-05-2018 2/2 specific allegation against the petitioner of demanding ransom from the victim and his active involvement in the crime. Considering the nature of allegations, this court, for the present, is not inclined to enlarge the petitioner on bail. The prayer for bail of the petitioner is rejected.
