The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 414 of the Indian Penal Code and Section 30 (a)/41 of the Bihar Prohibition and Excise Act, 2016.
Prosecution case is that the recovery of 40 kg. of Mahua kept in a plastic bag on motorcycle and the Motorcycle bearing Registration No. BR 27E2703.
Learned counsel for the petitioner submits that there is no recovery from the conscious possession of the petitioner. The petitioner is innocent committed no offence and has been falsely implicated in the present case only on the basis of alleged

In the aforesaid facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional District and Sessions Judge-cum-Special Judge, Nawada in connection with Rajauli P.S.
