====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 27-03-2025 Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend arrest in a case registered for the offence punishable sections 25(1-B)(a), 25(1-A), 25(1AA), 26(i)(ii)(iii) and 35 of the Arms Act.

3. As per prosecution case, house of co-accused Azim Ansari was raided and arms and ammunition were recovered from there.

4. It is submitted on behalf of the petitioners that no incriminating article has been recovered from the conscious possession of the petitioners and these petitioners are no way concerned with the said illegal activity. Co-accused, with similar

Patna High Court CR. MISC. No.75774 of 2024(2) dt.27-03-2025 2/2 allegation, has already been allowed pre-arrest bail by a coordinate bench of this Court vide order passed in Cr.Mis.No. 22317/2024. Petitioners claim clean antecedent.

5. Learned counsel for the State opposes the prayer for bail.

6. Considering the aforesaid facts of the case, prayer for bail of all the petitioners is allowed. In the event of arrest/surrender within eight weeks from today, let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jamui in Khaira Police Station Case No. 284 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
