JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-05-2018 Heard both the parties. The petitioner seeks regular bail in connection with Paroo P.S.Case No. 13 of 2017 for the offence under Sections 25 (1-b) a/26/35/25 (1-AA)/25 (1- AAA) of the Arms Act, 3/4 Explosive Substance Act and Sections 16, 17, 18 (A), 19, 20 and 21 U.A.P.A.
Earlier prayer for bail of the petitioner was rejected vide order dated 17.05.2017 passed in Cr. Misc. No.23537 of 2017 and again vide order dated 03.01.2018 passed in Cr. Misc. No. 63672 of 2017 with a direction to renew his prayer for bail after framing of charge in this case.
Allegation is that members of Naxalite Organization have to convene meeting in Panchayat Bhawan and
Patna High Court Cr.Misc. No.25160 of 2018 (3) dt.16-05-2018 2/2 Superintendent of Police reached there and apprehended six accused persons and they disclosed the name of the petitioner. Submission of the learned counsel for the petitioner is that up till now charge has not been framed and though he is in custody for 15 months and even sanction order has not been obtained.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- ( Rupees Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Sessions Paroo P.S.Case No. 13 of 2017, subject to the conditions that one of the bailors of the petitioner must be a local person having sufficient immovable property within the jurisdiction of the concerned Court and he will cooperate in the disposal of the trial, failing which his bail bond will be cancelled (Vinod Kumar Sinha, J) Sudha/- U T
