JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Khagaria P.S. Case No. 41 of 2019 registered for the offence punishable under Sections 366A/34 of the Indian Penal Code.

As per FIR daughter of 12 years of the informant has been kidnapped by one Karan Paswan and it is said that petitioner assisted in kidnapping and the girl is still traceless. Submission of learned counsel for the petitioner is that he has falsely been implicated and except that he assisted the main accused there is no other allegation against him and considering the same other co-accused has been granted anticipatory bail by a co-ordinate Bench of this Court by order dated 29.7.2019 passed in Cr.Misc.No. 44092 of 2019. Heard learned APP also.

No.67692 of 2019(2) dt.24-10-2019 2/2 In view of above facts and circumstances, let petitioner surrender in the court below and on surrender he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria, in connection with Khagaria P.S. Case No. 41 of 2019, corresponding to G.R.No. 160 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition that petitioner has to appear before the I.O. within 10 days of his release and he will co-operate in the investigation in tracing out the girl, otherwise his bail bonds shall be cancelled.
