Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

Petitioner is husband of victim of murder. He is in custody since 08.06.2016. Suspicion is that the petitioner and others committed murder of the wife of the petitioner by bitterly assaulting her.

Submission of the learned counsel for the petitioner is that there is no eye witness of the occurrence. Learned counsel for the informant opposed the prayer for bail.

However, does not dispute that there is no eye witness of the occurrence.

Considering the facts of this case especially

Patna High Court Cr.Misc. No.26141 of 2018 (4) dt.20-06-2018 2/2 period already undergone by the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sessions Trial No.264 of 2016 arising out of Chandradeep Police Station Case No.38 of 2016, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
